City Council Action Summary - April 17, 2006
  1. Held public hearing for 2007 Operating Budget.

  2. Elected Terry Goodman as Council President.

  3. Approved the following new appointments to the Code Board of Appeals:  1) Darrell Stein, P.E. – Term 12/01/03 to 12/01/06; and 2) Jeff DeGasperi, AIA – Term 12/01/04 to 12/01/07. 

  4. Approved the following reappointments to the Code Board of Appeals:  1) James Haas – Term 12/01/05 to 12/01/08; and 2) John L. Kaiser – Term 12/01/05 to 12/01/08. 

  5. Approved the following Consent Agenda items:  PUBLIC SAFETY:  Committee Items:  1) Ordinance No. TC-1260,EEE – Adopting inattentive driving regulations in the City with the exception of the first sentence which reads, “Any person operating a vehicle on the highway shall give his full time and entire attention to the operation of the vehicle;” and 2) Agreement with ADPI EMS Billing for medical billing and accounts receivable services for ambulance transports.      Staff Items:  One application for renewal of Massage Therapy and           In-Office Massage for Therapy License for Body Mechanix, 8665 W. 96th Street.  FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT:  Staff Items:  1) Council minutes of February 13, 2006; 2) Confirmation of investments totaling $2,213,323.09 in U.S. Agency Securities; 3) Expenditure Ordinance No. 4A – Outlining the expenditures from the General Operating Fund for March 23 through April 5, 2006; 4) Capital Projects Expenditure Ordinance No. 4B – Outlining the expenditures from the Capital Projects funds for April 6 through April 12, 2006; 5) One application for renewal of Drinking Establishment License for Ja-Ho, Inc, d/b/a Izumi Steak and Sushi, 13366 Metcalf; 6) Three applications for renewal of Drinking Establishment Licenses contingent on receiving state licenses as follows:  a) Jersey Boyz Subs and Deli, Inc., d/b/a Jersey Boyz Subs and Deli, 15102 Travis Street; b) Jose Pepper’s, Inc., d/b/a Jose Peppers, 10316 Metcalf; and c) Spin Concepts, Inc., d/b/a Spin Pizza, 6541 W. 119th Street; 7) Application for renewal of Class B Private Club License contingent on receiving state license for Red Bull Club, Inc., d/b/a The Fox, 7520 Shawnee Mission Parkway; 8) Applications for renewal of Cereal Malt Beverage Licenses as follows:  a) Old Town Pizza, L.L.C., d/b/a Old Town Pizza, L.L.C., 14850 Metcalf; and b)Queen-Morris Ventures, L.L.C., d/b/a Queen Price Chopper No. 4, 8686 Antioch; 9) One application for Temporary Permit to Sell Cereal Malt Beverage contingent on approval of Special Event Permit for Rotary Club of Overland Park for an event to be held on July 4, 2006, from 4 p.m. until 11 p.m. at 9711 W. 109th Street; and 10) Request to Extend Premises to Sell Alcoholic Liquor at Chili’s of Kansas, Inc., d/b/a On the Border Mexican Café, for a one-day event to be held Friday, May 5, 2006, from 11 am until 12 a.m., 11855 West 95th Street.  

    Approved Report to the Governing Body No. 06-02 to delay scheduling the required public hearing until May 15, 2005, to allow the owner a reasonable time within which to abate the unsafe and dangerous condition of the structure at 7924 Santa Fe Drive.

  6. Approved the low bid of $11,260 from Hannah Rubber Company for a self-weighted hose for aeration systems to be installed at Summercrest Lake Park, Amesbury Lake Park, Wilderness Lake Park, Regency Lake Park and golf courses.   
     
  7. Approved the Agreement with Board of County Commissioners of Johnson County and the City of Olathe for authorization for the grant application through the Edward J. Byrne Memorial Justice Assistance Grant Program in the amount of $33,661 with no matching funds required, and grant funding to be provided to the Johnson County Criminalistics Laboratory Crime Scene Unit. 

  8. Rejected all bids for the 2006 Sidewalk Repair Program. 

  9. Approved low bid of $804,401.60 from APAC – Kansas, Inc., for the 133rd Street and Lamar Roundabout. 
       
  10. Approved low bid of $1,936,760.65 from APAC – Kansas, Inc., for 127th Street, Foster to Metcalf, and Foster north and south of 127th Street (Improvement District No. 05-192).

  11. Approved Resolution No. 3523 – Accepting the best bid from Piper Jaffray at an interest rate of 4.3196 percent for $34,885,000 principal amount of Internal Improvement Bonds, Series 2006A, of the City, and authorizing further action in connection with the issuance and sale of said bonds. 

  12. Approved Resolution No. 3524 – Prescribing the form and details of and authorizing the delivery of Internal Improvement Bonds, Series 2006A, in the principal amount of $34,885,000 from Piper Jaffray and making certain covenants with respect thereto.

  13. Approved the following recommendations from the Planning Commission Consent Agenda, including all stipulations:  1) Special Event Permit No. 2006-103, 9711 West 109th Street, to allow the annual 4th of July fireworks and concert in Corporate Woods; 2) Special Event Permit No 2006-107, 11855 West 95th Street, to allow a Cinco de Mayo celebration at On the Border Mexican Café on May 5, 2006; 3) Special Event Permit No. 2006-108, 10700 Nall, to allow a detached sign to be displayed for 30 days at the National Bank of Kansas City; 4) Special Event Permit No. 2006-114, 9720 Metcalf, from May 7 to October 31, 2006, to allow remote control car racing in the front parking lot of Regency Park Shopping Center on Sunday mornings; 5) Special Event Permit No. 2006-116, 10500 Quivira, from February 1 to June 1, 2006, to allow a mobile catheterization lab for Overland Park Regional Medical Center; 6) Acceptance of Right-of- Way, Final Plat No. 2006-5 for Crystal Court Town Homes First Plat, 88th Street and Farley; 7) Acceptance of Right-of-Way for Final Plat No. 2006-8 for Blue Valley Recreation Ball Fields, 135th Street and Grandview; 8) Acceptance of Right-of-Way for Final Plat No. 2006-9 for Blue Valley Aquatic Center, 6545 West 151st Street; 9) Revised Preliminary Approval for Rockbrook Office Park, northwest corner of 143rd Street and Metcalf; and 10) Ordinance No. Z-3206 (Special Use Permit No. 2006-4), 7030 West 105th Street, for a five-year period of time to allow an arcade at Buffalo Wild Wings.
