City Council Action Summary - March 6, 2006
  1. Held public hearing on the issuance of Economic Development Revenue Bonds and approved Resolution No. 3512 declaring the intent of the City to issue Federally Taxable Private Activity Revenue Bonds in the aggregate principal amount not to exceed $47,661,000 for the purpose of financing the acquisition, construction and equipping of a research facility for Quintiles, Inc., and to grant property tax exemption.

  2. Presented awards to Bryan-Ohlmeier Construction Company, Inc., and Pyramid Contractors, Inc., for Excellence in Construction in 2005.

  3. Approved the following Consent Agenda items:

    COMMUNITY DEVELOPMENT: COMMITTEE ITEMS:

    1. Adopt proactive enforcement policies relating to property maintenance issues throughout the City;
    2. Informational item: Public hearing scheduled to be held at the Community Development Committee meeting on April 5, 2006, to consider increasing the Public Improvement Fees;
    3. Ordinance No. SWP-2562 - Establishing requirements relating to storm water pollution to the City’s storm sewers and surface waters;
    4. Approved as revised Ordinance No. GS-2598 relating to the regulation of garage sales in the City;
    5. Resolution No. 3510 – Sewer District Enlargement in the vicinity of the northeast corner of 159th Street and Quivira;
    6. Approved the 2007 Park Improvement Projects.

      PUBLIC SAFETY: STAFF ITEMS:

    1. Application for renewal of Massage Therapy and In-Office Massage Therapy License – Hands On Massage Therapy, 7060 W. 105th Street.

    PUBLIC WORKS: COMMITTEE ITEMS:

    1. Street Improvements – 80th Street, Antioch to Grant;
    2. Median Breaks – Nall, 143rd Street to 159th Street;
    3. Waiver of bid process and authorization to negotiate purchase – Mid American Signal for the purchase of Opticom devices in the amount of $119,580.

    STAFF ITEMS:

    1. Ordinance No. MTI-2606 providing for the public improvement of main trafficways – I-435, Antioch, U.S. 69 Highway, and 103rd Street within the City.

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT: STAFF ITEMS:

    1. Confirmed investments in the amount of $9,415,000 in U.S. Agency Securities;
    2. Expenditure Ordinance No. 2B – Outlining the expenditures from the General Obligation Fund for February 9 through February 22, 2006;
    3. Capital Projects Expenditure Ordinance No. 2D – Outlining the expenditures from the Capital Projects funds for February 16 through February 22, 2006;
    4. Capital Projects Expenditure Ordinance No. 3A – Outlining the expenditures from the Capital Projects funds for February 23 through March 1, 2006;
    5. Application for renewal of Drinking Establishment License contingent on receiving State License – The Athletic Club of Overland Park, L.L.C., d/b/a The Athletic Club of Overland Park, 10440 Marty;
    6. Application for renewal of Cereal Malt Beverage License – The Lotias, Inc., d/b/a 75th BP Amoco, 7446 Metcalf.

  4. Approved waiver of the bid process and authorized staff to negotiate a contract with Deffenbaugh Industries, Inc., for the 2006 Spring Large Item Collection.

  5. Approved Officiating Services Agreement with Sports Management Associates, L.C., for softball officiating fees in the amount of $21/official/game for 2006 and $22/official/game for 2007 and 2008.

  6. Accepted low bid from Pyramid Contractors, Inc., in the amount of $5,249,247.50, for the improvement of Switzer Road, 135th Street to 141st Street.

  7. Approved Change Order No. 1 – Comanche Construction, Inc., for additional work on the expansion joint seal replacement (75th Street and Turkey Creek and Pflumm Road 1000 feet north of 127th Street) project for an additional amount of $23,015.

  8. Approved Change Order No. 7 – Pyramid Contractors, Inc., for an additional amount of $56,228.45 for the U.S. 69 Northbound ramp and 135th Street widening improvements.

  9. Approved Agreement with Bucher, Willis and Ratliff Corporation for the design of the 151st Street and U.S. 69 Interchange for a fee not to exceed $151,000.

  10. Announced that the Finance, Administration and Economic Development Committee is scheduled to be held on Monday, March 20, 2006, at 6 p.m.

  11. Approved the following Planning Commission Consent Agenda items as stipulated:

    1. Special Event Permit No. 2006-64, 13428 Metcalf, to allow a banner from March 2 to October 31, 2006, for Lifetime Fitness;
    2. Special Event Permit No. 2006-69, 7324 West 80th Street, to allow a “Bike Nite” promotion from May 17 to October 25, 2006, for The Other Place Restaurant;
    3. Special Event Permit No. 2006-77, vicinity of Santa Fe Drive, between 79th Street and 80th Street, to allow a series of special events in Downtown Overland Park for 2006;
    4. Acceptance of Right-of-Way – Final Plat No. 2005-115 – Colton Lake South First Plat, vicinity of the southwest corner of 156th Street and Switzer;
    5. Acceptance of Right-of-Way – Final Plat No. 2005-128, The Vineyard First Plat, vicinity of 159th Street and Bluejacket;
    6. Acceptance of Right-of-Way – Final Plat No. 2006-4 - Kansas Mission Church First Plat, 8841 Glenwood;
    7. Revised Preliminary Plan – Overland Park International Trade Center, 6800 West 115th Street;
    8. Ordinance No. Z-3201 (Special Use Permit No. 2006-2), 8602 West 133rd Street, for a three-year period of time to allow a drinking establishment.

  12. Approved Ordinance No. VAC-2602 (Storm Sewer Easement Vacation No. 2006-1), vicinity of 163rd Terrace and Roe, with no stipulations.

  13. Approved Ordinance No. Z-3199 (Rezoning No. 2004-29), 15120 Switzer, to rezone to RP-OE, Planned Open Space Estate Residential District, to allow the development of an open space single-family subdivision, with stipulations a through l.

  14. Remanded back to the Planning Commission Special Use Permit No. 2005-38, vicinity of the southeast corner of 127th Street and Pflumm, with direction to reduce the density and to consider reducing the mass and scale of the four-unit and five-unit buildings.

  15. Approved Settlement Agreements relating to claims made by the City concerning actuarial and other consulting services provided to the Overland Park Fire Department, Inc., Restated Retirement Plan.
