City Council Action Summary - Aug. 1, 2005
  1. Moved that the public hearing which was set July 11, 2005, by Resolution No. 3466 to consider the addition of real property to the Redevelopment District, and which was recessed and continued to August 1, 2005, be further recessed and continued to Monday, August 15, 2005.

  2. Confirmed election of Harvey Bodker to Board of Directors for the Arts and Recreation Foundation Board.

  3. Approved the following Consent Agenda Items:

    PUBLIC SAFETY: Committee Items:

    1. Agreement with Blue Valley Unified School District No. 229 for the provision of School Resource Officers for the 2005-2006 school year;
    2. Agreement with Shawnee Mission Unified School District No. 512 for the provision of School Resource Officers for the 2005-2006 school year;
    3. Agreement with St. Thomas Aquinas High School for the provision of a School Resource Officers for the 2005-2006 school year; and
    4. Ordinance No. POC-2570 – Relating to the criminal use of weapons.

    Staff Items:

    1. Three applications for Renewal of Massage Therapy Licenses, as listed on the agenda.

    PUBLIC WORKS: Committee Items:

    1. Recommendation by the Public Works Committee not to install the Dynamic Message Sign, 131st Place and Antioch, and to review future installation at this location as funding becomes available for a bridge over U.S. 69 Highway at 132nd Street;
    2. Changes to Ordinance No. STR-2569 requiring an 11-foot radius minimum size for cul-de-sac islands within the City;
    3. Waiver of Consultant Selection Process and approval of Supplemental Agreement No. 1 to the existing Consultant Agreement with Paul Jorgensen Group, L.L.C., for additional services for the Overland Park Event Center in an amount not to exceed $40,100.

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT: Committee Items:

    1. Compensation for Municipal Court Judges – Base Compensation to be increased by 4.01 percent in accordance with the formula outlined in Section 10(e) of Resolution No. 3419, with increase to be effective from the period September 1, 2005, to August 31, 2006;
    2. Ordinance No. MCC-2572 – Changing the position titles of “Court Services Officer” to “Court Security Officer” and providing authorization for the Court Administrator to receive training in the supervision of commissioned personnel;
    3. Request for Waiver of Policy Provisions – Permitting Overland Park Fire Department to continue to engage Conrad Fire for the limited purpose of maintaining existing equipment;
    4. Ordinance No. AL-2566, which will authorize Sunday sales of alcoholic beverages at package liquor stores as well as permit Sunday sales of cereal malt beverage or 3.2 beer at grocery and convenience stores in the City;
    5. Ordinance No. MEP-583,Y - Amendment Number Six to the Restated Overland Park, Kansas, Municipal Employees Pension Plan and Trust Agreement, which amends the current Municipal Employees Pension Plan to comply with recent Internal Revenue Code changes related to how funds are handled for former employees and to expand the plan’s current definition of compensation to include performance based compensation not currently included in the plan’s definition of compensation; and
    6. Budget Amendment to increase the 2005 Budget for the Bond and Interest Fund by $709,000, from $16,041,000 to $16,750,000 and directed the staff to schedule a public hearing on the amendment for August 8, 2005.

    6. One application for New Drinking Establishment License Contingent on Receiving State License, as listed on the agenda;
    7. Two applications for Renewal of Drinking Establishment Licenses, as listed on the agenda;
    8. Three applications for Renewal of Drinking Establishment Licenses Contingent on Receiving State Licenses, as listed on the agenda;
    9. One application for New Cereal Malt Beverage License, as listed on the agenda; and

  4. Accepted bid from Torgeson Electric in the amount of $344,000 for 2005 Residential Streetlights and Street Lighting Maintenance Projects.

  5. Accepted bid from Miles Excavating, Inc., in the amount of $1,331,171.55 for the 2005 CDBG Program (Robinson, 83rd Street to Santa Fe; 85th Street, Lowell to Robinson; Broadmoor, 81st Street north approximately 100 feet; and Travis, 83rd Street to 82nd Street) and 2006 Residential Street Program, Part 3 (76th Street, Metcalf to Walmer).

  6. Approved the following Planning Commission Consent Agenda Items, as stipulated:
    1. Special Event Permit No. 2005-327, 5750 West 117th Street, to allow several banners at the Sprint Campus from early August through November 11, 2005;
    2. Preliminary Plan for Abdallah Shrine Garage, 5300 Metcalf;
    3. Acceptance of Right-of-Way – Final Plat No. 2005-55 for Shawnee Mission South High School Second Plat, 5800 West 107th Street;
    4. Continuation of Special Use Permit No. 2005-21, 8601 West 75th Street, to the September 19, 2005, Council meeting; and
    5. Ordinance No. Z-3152 (Rezoning No. 2005-12), 7742 Antioch, from R-1, Single-Family Residential District, to RP-3, Planned Garden Apartment District, to allow a cluster housing development.

  7. Continued Right-of-Way Vacation No. 2005-8, vicinity of 81st Terrace east of Mastin, to the September 12, 2005, Council meeting.
