City Council Action Summary - May 17, 2004
  1. Proclaimed the week of May 16-22, 2004, as National Public Works Week.

  2. Appointed Ric Cummings as a new member to the Arts Commission.

  3. Appointed Linda Patterson as a new member to the Legacy of Greenery Committee.

  4. Approved recommendation from Committee-of-the-Whole meeting and approved Ordinance No. A-2495, as amended, to include the words “as extended” after the words “167th Street” in the third line of the title of the ordinance, incorporating and annexing land located on the south side of 167th Street and on the east side of Pflumm Road into the limits and boundaries of the City.

  5. Approved the following consent agenda items:

COMMUNITY DEVELOPMENT – Staff Item:

  1. Contract with Valley View Bank to conduct the Home Improvement Partnership Program for the period July 1, 2004, to July 1, 2005.

PUBLIC SAFETY – Committee Item:

  1. Agreement with Sagem Morpho, Inc., for maintenance of live-scan fingerprint equipment and automated fingerprint identification system (AFIS) in the amount of $37,673.01.

Staff Items:

  1. One application for new massage therapy and in-office therapy license, as listed on the agenda;
  2. One application for renewal of massage therapy and in-office massage therapy license as listed on the agenda.

PUBLIC WORKS – Staff Items:

  1. Resolution No. 3393 setting forth findings and determinations of the Governing Body on the advisability of the creation of an improvement district for the installation of a bank retaining structure as well as grading, excavation and restoration to improve bank stability and to help protect the property located along the south bank of a portion of Indian Creek within Country-shire subdivision (Improvement District No. 04-191);
  2. Resolution No. 3394, authorizing and providing for the creation of an improvement district for the installation of a bank retaining structure as well as grading, excavation and restoration to improve bank stability and to help protect the property located along the south bank of a portion of Indian Creek within Countryshire subdivision (Improvement District No. 04-191).

FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT – Staff Items:

  1. Council minutes – May 3, 2004;
  2. Confirmed investments totaling $3,462,400.42 in U. S. Agency Securities;
  3. Expenditure Ordinance No. 5A, outlining the expenditures from the General Operating Fund for April 22 through May 5, 2004;
  4. Capital Projects Expenditure Ordinance No. 5B, outlining the expenditures from the Capital Projects Funds for May 6 through May 12, 2004;
  5. One application for renewal of drinking establishment license as listed on agenda;
  6. One application for renewal of drinking establishment license contingent on receiving state license and Fire Code approval as listed on agenda;
  7. Four applications for renewal of drinking establishment licenses contingent on receiving state licenses as listed on the agenda;
  8. One application for renewal of cereal malt beverage license as listed on agenda;
  9. One application for renewal of Class B private club license contingent on receiving state license as listed on the agenda;
  10. One application for temporary permit to sell cereal malt beverages as listed on the agenda;
  11. One application for temporary permit to sell alcoholic liquor as listed on the agenda.

  1. Reported that June 9th Public Safety meeting has been rescheduled to June 28, 2004.

  2. Approved agreement with SK Design Group, Inc., in the amount of $95,351, for engineering services for the construction of storm drainage improvements for the area generally described as extending 200 feet north of the intersection of 72nd Terrace and Lowell Avenue to the intersection of 74th Street and Conser Drive (Milburn Fields Drainage Improvements.)

  3. Approved Planning Commission consent agenda items: (1) Special Event Permit No. 2004-151, 7126 West 80th Street, to allow ‘Pickin on the Patio,’ Monday nights between Memorial Day and Labor Day; (2) Ordinance No. Z-3069 (Rezoning No. 2004-11), 12640 and 12530 West 159th Street, to rezone from A-J, Agricultural District Johnson County, to A, Agricultural District, to allow residential construction.

  4. Recessed into executive session to discuss matters subject to attorney/ client privilege relating to the lawsuits entitled Fruits et al. v. City of Overland Park and Nolan et al. v. City of Overland Park.
