City Council Action Summary - Aug. 4, 2003

  1. Held public hearing on 2004 Budget.

  2. Approved new appointment to the Legacy of Greenery Committee for J. Kenneth Myers.

  3. Approved new appointment to the Board of Trustees-Municipal Employees Pension Plan for Marga Spangler.

  4. Approved new appointment to the Arts Commission for Sally A. Anderson.

  5. Approved the following consent agenda items:

    PUBLIC SAFETY – Staff Items:

    1. Two applications for new massage therapy licenses;
    2. Two applications for renewal of massage therapy licenses, as listed on the agenda.

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOP- MENT – Staff Items:

    1. Confirmed investments totaling $4,036,611.82 in U.S. Agency Securities;
    2. Expenditure Ordinance No. 7B, outlining the expenditures from the General Operating Fund for July 3 through July 16, 2003;
    3. Capital Projects Expenditure Ordinance No. 7D, outlining the expenditures from the Capital Projects Funds for July 17 through July 23, 2003;
    4. Capital Projects Expenditure Ordinance No. 7E, outlining the expenditures from the Capital Projects Funds for July 24 through July 30, 2003;
    5. One application for new cereal malt beverage license as listed on the agenda;
    6. One application for renewal of drinking establishment license as listed on the agenda;
    7. Three applications for renewal of drinking establishment licenses contingent on receiving state licenses as listed on the agenda.

    COMMUNITY DEVELOPMENT – Staff Items:

    1. Ordinance No. MW-2446, levying special assessments against certain parcels of land within the City in order to pay the costs incurred from cutting weeds and other noxious growth on said parcels.

  6. Rejected the low bid from Double Check Company, Inc., for a compressed natural gas fueling station, in the amount of $489,000 because it exceeded the engineer’s estimate of $450,000.

  7. Approved low bid from Pyramid Excavation and Construction, Inc., in the amount of $86,000, for Fueling Station site improvements at the Blue Valley Public Works Maintenance facility to provide more parking.

  8. Approved waiver of bid process and authorization to purchase up to 8,000 tons of salt from Cargill Salt Company at $23.50/ton for 2003-2004 salt purchase, which would result in a $50,000 savings over what had been anticipated.

  9. Approved agreement with Brungardt Honomichl & Company, P.A. for design of the 2005 Residential Street Program, Part 2, as outlined on the agenda.

  10. Closed file regarding Abatement of Unsafe and Dangerous Structure at 10106 Moody Park Drive, because the dangerous and unsafe condition has been abated, and insurance proceeds have been returned to insured.

  11. Closed file regarding Abatement of Unsafe and Dangerous Structure at 15235 Hemlock Street, because the dangerous and unsafe condition has been abated, and insurance proceeds have been returned to insured.

  12. Approved the following Planning Commission consent agenda items:
    1. Special Event Permit No. 2003-310, southeast corner of 95th Street and Metcalf Avenue, to display banners for a series of six events from July 26, 2003, through April 26, 2004;
    2. Special Event Permit No. 2003-314, 15314 Kenneth Road, to allow a corn maze for a two-month period of time;
    3. Acceptance of Right-of-Way, Final Plat No. 2003-31, Colonial Presbyterian Church Second Plat, 12501 West 137th Street;
    4. Accep-tance of Right-of-Way, Final Plat No. 2003-49, Windsor Hills Fifth Plat, 148th Street and Conser;
    5. Ordinance No. Z-3004 (Rezoning No. 2003-9), 159th Street and Roe Avenue, to rezone from RP-3, Planned Garden Apartment District, and A-J, Agriculture District Johnson County, to RP-4, Planned Cluster Housing District, to allow a multifamily development;
    6. Ordinance No. Z-3002 (Rezoning No. 2003-6), 135th and U.S. 69 Highway, to rezone from R-1, Single-Family Residential District, to BP, Business Park District, to allow a business park;
    7. Ordinance No. Z-3003 (Special Use Permit No. 2003-12), southeast corner of 135th Street and U.S. 69 Highway, for an indefinite period of time, to allow for two hotels;
    8. Ordinance No. Z-3005 (Special Use Permit No. 2003-22), 12611 Metcalf, for a five-year period of time for the renewal of a drinking establishment;
    9. Ordinance No. Z-3006 (Special Use Permit No. 2003-23), 9914 West 87th Street, for a five-year period of time to allow the renewal of a drinking establishment;
    10. Ordinance No. Z-3007 (Special Use Permit No. 2003-24), 14225 Dearborn Street, for a five-year period of time for the renewal of a drinking establishment for a private golf course;
    11. Ordinance No. ZRR-2439 (Unified Development Ordinance Amendment No. ZRR-2439), amendments to Section 18.180.070 (C) of the Unified Development Ordinance relating to the development and performance standard for nonresidential uses in a residential district;
    12. Ordinance No. ZRR-2440 (Unified Development Ordinance Amendment No. ZRR-2440), amendments to Section 18.140.150 (D) of the Unified Development Ordinance amending the number of affirmative votes required where a valid protest petition has been filed.

  13. Approved Residential Day Care Permit No. 2003-3, 5841 Marty Street, for the renewal of a residential day-care permit for a five-year period of time.

  14. Ordinance No. AL-2447, relating to alcoholic liquor in the City, amending Section 5.48.080, to make it conform to the days and hours of selling package liquor allowed in Charter Ordinance No. Eighty-Two.

  15. Denied motion to rescind action taken by the Governing Body on July 21, 2003, regarding request for waiver of six-month limitation on successive rezoning applications set out in the Unified Development Ordinance, Section 18.140.460, with regard to property located in the vicinity of the northeast corner of 159th Street and U.S. Highway 69.

  16. Recessed into executive session for a period of 20 minutes for the purpose of discussing matters subject to attorney/client privilege relating to enforcement of the City's wood roof ordinance.
