OP City Council Action Summary - Feb. 3, 2003

  1. Held public hearing on 2004-2008 Capital Improvement Program.

  2. Held public hearing on Traffic Calming Policy and approved the scheduling of a Committee-of-the-Whole meeting for February 17, 2003, to continue discussion of this item.

  3. Presented Award for 2002 Excellence in Construction to Leavenworth Excavating & Equipment Company, Inc., and Vance Brothers, Inc.

  4. Approved the following reappointments the Civil Service Commission for the terms of 1/06/03 to 1/06/06: Marie Lear, Katie Washington and Georgia K. Erickson.

  5. Approved the following reappointments to the Landmarks Commission for the terms of 2/20/03 to 2/20/06: Charlene Conrad and Dave Hill.

  6. Approved the following reappointments to the Board of Zoning Appeals: William A Kidder, Jr., for the term of 9/14/02 to 9/14/05 and Don Carter for the term of 1/10/03 to 1/10/06.

  7. Approved appointment of Eric (Ric) Johnson to the Board of Zoning Appeals for the term of 5/02/01 to 5/02/04.

  8. Approved the following Consent Agenda Items:

    PUBLIC WORKS: Committee Item:

    1. National Pollutant Discharge Elimination System (NPDES) Phase II Permit Action Plan and Permit Application for signature and submittal by the City Manager, subject to any final revision required prior to submittal to the Kansas Department of Health and Environment.

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT: Committee Items:

    1. One-Eighth of One Percent Sales Tax – Authorization of contingency funds in the amount of $14,000 for printing and mailing of election information; and
    2. Disposal by sale of Public Works Vehicles/Equipment, as listed.

    Staff Items:

    1. Council Minutes – December 2, 2002, and January 6, 2003;
    2. Confirmed investments totaling $1,000,000 in CD’s and $12,922,546.67 in U. S. Agency Securities;
    3. Expenditure Ordinance No. 1B – Outlining the expenditures from the General Operating Fund for January 2 through January 15, 2003;
    4. Capital Projects Expenditure No. 1B – Outlining the expenditures from the Capital Projects Funds for January 9 through January 15, 2003;
    5. Capital Projects Expenditure Ordinance No. 1C – Outlining the expenditures from the Capital Projects Funds for January 16 through January 22, 2003;
    6. Capital Projects Expenditure Ordinance No. 1D – Outlining the expenditures from the Capital Projects Funds for January 23 through January 29, 2003;

    COMMUNITY DEVELOPMENT: Committee Items:

    1. Extension of Golf Professional, Tim Eleeson’s Last Buyout Payment of $14,314.25 to May 1, 2003;
    2. Waive Bid Process and Solicit Requests for Proposals for design and construction of a playground system at the Community Park; and
    3. Resolution No. 3311 – Consenting to the enlargement of a sewer district to provide for the development of an elementary school in the vicinity of the northwest corner of 165th Street and Antioch Road.

    PUBLIC SAFETY: Staff Items:

    1. Applications for renewal of three Massage Therapy Licenses and one In-Office Massage Therapy License, as listed on the agenda.

  9. Approved Change Order No. 2 from Lan-Tel Communications Service, Inc., for CityNet Communication System Project for an additional amount of $48,594.80.

  10. Approved low bid of $7,702 from Banta Publications Group, Liberty, Missouri, for the per issue cost of printing the 2003 Overview Newsletter.

  11. Approved low bid of $107,269.12 from S & F Mowing, Shawnee, Kansas, for mowing of park areas and greenway linkages through- out the City for 2003 and 2004.

  12. Authorized execution of contracts to purchase seven properties, as listed in the Parks & Recreation Memo dated January 29, 2003, contingent upon receipt by staff of acceptable environmental site assessments, with funding provided in the 2003 CIP Project No. PB-0363A Community Center Land Acquisition.

  13. Approved the following Planning Commission Consent Agenda Items including all stipulations:
    1. Acceptance of Right-of-Way – Final Plat No. 2002-103, South Edgewater Development, 14885 Metcalf Avenue;
    2. Acceptance of Right-of-Way – Final Plat No. 2002-107– James Park Estates, First Plat, 131st Terrace and Reeds Road;
    3. Acceptance of Right-of-Way – Final Plat No. 2002-108 – Fairfield Manor, Fourth Plat, 123rd Street and Rosehill Road;
    4. Ordinance No. Z-2966 (SUP No. 2002-32) – Southeast corner of 117th Street and Nieman Road, for an indefinite period of time to allow an assisted living/nursing facility;
    5. Ordinance No. Z-2967 (SUP No. 2002-33), 9000 W. 137th Street, for a five-year period of time to allow a drinking establishment;
    6. Ordinance No. Z-2968 (SUP NO. 2002-34), 10316 Metcalf Avenue, for a five-year period of time to allow a drinking establishment;
    7. Ordinance No. Z-2969 (SUP No. 2002-35), 9120 Nieman Road, for a two-year period of time to allow a driver education school and automotive conversion business;
    8. Ordinance No. Z-2970 (SUP No. 2002-36), 11168 Antioch Road, for a five-year period of time to allow a drinking establishment;
    9. Ordinance No. Z-2964 (Rezoning No. 2002-18, northwest corner of 167th Street and Antioch Road, from RURJ, Rural District Johnson County, to R-1, Single-Family Residential District, to allow a church; and
    10. Ordinance No. Z-2965 (Rezoning No. 2002-19) 12601 W. 156th Street, from A-J, Agricultural District Johnson County, to RE-Residential Estates District, to construct a single-family home.

  14. Continued Storm Drainage Easement Vacation No. 2002-11 to the February 17, 2003, meeting.

  15. Upheld the Planning Commission’s recommendation to deny Right- of-Way Vacation No. 2002-12, vicinity of Nicklaus Drive, south of Golden Bear Drive.

  16. Recessed into executive session for a period of time not to exceed five minutes to discuss matters of attorney/client privilege related to Douglas Dezube, et al, versus the City of Overland Park, Case No. 02CV06013.
