OP City Council Action Summary - Dec. 2, 2002

  1. Held public hearing and approved Ordinance No. SUMC-2412, authorizing the City of Overland Park, Kansas, to issue federally taxable private activity revenue bonds, series 2002 (Sprint/United Management Company Project), in the principal amount of $57,000,000 for the purpose of providing funds to pay a portion of the cost of acquiring, purchasing, constructing, installing, furnishing, equipping and reequipping a corporate headquarters located within the City, including real estate, buildings, improvements, machinery and equipment; authorizing the City to enter into a sixth supplemental trust indenture with the trustee; authorizing the City to enter into a sixth supplemental lease agreement with Sprint/ Management Company; and authorizing and approving the execution of certain documents and the taking of other actions in connection with the issuance of said series 2002 bonds.

  2. Approved addendum to report from the Committee-of-the-Whole meeting held on November 4, 2002, whereby the Committee recommended approval of Ward Districting Option 7, as embodied in Ordinance No. WB-2408, declaring and establishing ward boundaries within the City, with a change at the end of Section 7 on Page 7 from WB-2265 to correctly read WB-2369.

  3. Approved recommendation from the Committee-of-the-Whole meeting held on December 2, 2002, for the five-year financial planning assumptions and the financial standards, which include three new financial standards:
    1. Percentage of Operating Expenditures to General Fund Current Revenues;
    2. Percentage of Maintenance Expenditures to General Fund Expenditures;
    3. Percentage of Capital Expenditures to General Fund Current Revenue.

  4. Approved the consent agenda as follows:

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT – Committee Items:

    1. 2003 Special Alcohol Control Funds with $400,000 to various agencies which offer drug and alcohol prevention, education and treatment services to the City’s residents, based on report and recommendation of the Johnson County Drug and Alcoholism Council;
    2. Ordinance No. MEP-583,W, Amendment Number Four to the Restated Overland Park, Kansas, Municipal Employees Pension Plan and Trust Agreement;
    3. United HealthCare Services, Inc., for renewal of the City’s health and insurance plans;
    4. Waive bid process and authorize participation through the U.S. Communities Government Purchasing Alliance with Office Depot for purchase of office supplies for 2003;
    5. Waive bid process and authorize participation through the U.S. Communities Government Purchasing Alliance with Office Depot for purchase of copy paper for 2003;
    6. 2003 Annual Calendar of Meetings.

    Staff Items:

    1. Council minutes of November 4, 2002;
    2. Expenditure Ordinance No. 11B, outlining the expenditures from the General Operating Fund from October 7 through October 20, 2002;
    3. Capital Projects Expenditure Ordinance No. 11C, outlining the expenditures for the Capital Projects Funds for November 14 through November 20, 2002;
    4. Capital Projects Expenditure Ordinance No. 11D, outlining the expenditures from the Capital Projects Funds for November 21 through November 27, 2002;
    5. One application for new drinking establishment; two applications for renewal of drinking establishment licenses; and three applications for renewal of cereal malt beverage licenses, as listed on the agenda.

    PUBLIC SAFETY – Staff Item:

    1. Application for renewal of massage therapy license as listed on the agenda.

    PUBLIC WORKS – Committee Items:

    1. Directed staff to apply for a FEMA grant to purchase a limited number of flood-prone properties along a tributary of Indian Creek that runs from 97th Street to 103rd Street, between Roe and Rosewood;
    2. Reduce pavement thickness on selected residential subdivision street types with stabilized subgrade and retain the services of Dr. Robert Parsons to develop the necessary design and testing procedures;
    3. Ordinance No. RW-2410, relating to managing the use and occupancy of public right-of-way for the City;
    4. Resolution No. 3304, establishing plan review, permit, and inspection fees. Staff Item: Ordinance No. MTI-2411, providing for the public improvement of main trafficways, Blue Valley Parkway/Metcalf Avenue from 123rd Street to College Boulevard.

  5. Approved applications for one renewal of drinking establishment license and one renewal of Class A Private Club License, as listed on the agenda, contingent on receiving state licenses.

  6. Approved 60-month lease proposal from Savin Corporation, for two digital network copiers at a monthly lease cost of $900 per month.

  7. Approved contract with Downtown Overland Park Partnership, (DOPP) to provide services for downtown as outlined by the Business Improvement District Advisory Board.

  8. Approved the low bid from E-Z-Go Textron, in the amount of $227,500.59, for a three-year lease period, for 130 four-wheel golf carts and 1 beverage cart.

  9. Reported a date change from the Public Works Committee meeting, scheduled for December 23rd, to either Tuesday, December 17th or Thursday, December 19th.

  10. Approved bid tabulation from Mahurin’s Construction, in the amount of $163,580.35, for 2002 Minor Storm Sewer Repair.

  11. Approved the rescission of the contract award to Midway Sterling Truck Center for the purchase of a snowplow dump truck on October 7, 2002.

  12. Approved the Planning Commission consent agenda as follows, with the exception of item 5, Special Use Permit No. 2002-26, which was continued to the Council meeting of December 16, 2002:
    1. Revised Preliminary Plan Approval for Kohn’s Department Store Expansion, vicinity of the northeast corner of 119th Street and Metcalf;
    2. Acceptance of right-of-way for Final Plat No. 2002-79, Deer Creek Woods Second Plat, vicinity of 133rd Street and Metcalf;
    3. Acceptance of right-of-way for Final Plat No. 2002-80, Deer Creek Woods Third Plat, vicinity of 133rd Street and Metcalf;
    4. Acceptance of right-of-way for Final Plat No. 2002-81 for Village of Overland Pointe Sixth Plat, vicinity of the southeast corner of 135th Street and Antioch Road;
    5. Continued Special Use Permit No. 2002-26, vicinity of the southwest corner of 110th Street and Oakmont, to the Council meeting of December 16, 2002;
    6. Ordinance No. Z-2957 (Special Use Permit No. 2002-27), 7934 Robinson Street, for a five-year period of time to allow a residential group home;
    7. Ordinance No. Z-2958 (Special Use Permit No. 2002-28), 8113 Overland Park Drive, for a five-year period of time to allow a residential home;
    8. Ordinance No. Z-2959 (Special Use Permit No. 2002-30), 6675 West 119th Street, for a three-year period of time to allow a drinking establishment for the Cheesecake Factory restaurant;
    9. (Upheld Planning Commission’s recommendation to deny) Rezoning No. 2002-15, vicinity of the northwest corner of 143rd Street and Metcalf Avenue, to allow a commercial development;
    10. Ordinance No. Z-2955 (Rezoning No. 2002-16), vicinity of 154th Street and Switzer Road, to allow the construction of three homes.

  13. Reported the possibility of moving the December Finance, Administration and Economic Development Committee meeting from December 18, 2002, to December 16, 2002, prior to the Council meeting on that evening.
