OP City Council Action Summary - Nov. 4, 2002

  1. Proclaimed November 2002, as Lung Cancer Awareness month in Overland Park.

  2. Approved the following new appointments to the Arts and Recreation Foundation Board:
    1. Wilma J. (Billie) Lenz;
    2. Darlene Arnett.

  3. Heard report from the November 4, 2002, Committee-of-the-Whole meeting and approved the merger between the Overland Park Fire Department and the City of Overland Park, assuming that state legislation is approved regarding the OPFD firefighters pension, and with the merger to be effective July 1, 2003; and heard informational item regarding the recommendation from the Committee of the Whole to the Council to adopt an ordinance regarding the Ward Redistricting as indicated in Option No. 7, with Council action to be taken on December 2, 2002.

  4. Approved the following Consent Agenda items:
  5. PUBLIC WORKS: COMMITTEE ITEMS:

    1. Waiver of consultant selection process and authorization to negotiate contract – Affinis Corporation for design of Glenwood, 67th Street to 69th Street (includes Improvement District No. 02-189 and SMAC No. RC-10-005).

    FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT: STAFF ITEMS:

    1. Confirmed investments in the amounts of $15,213,060.17 in U.S. Agency Securities and $3,500,000 in Certificates of Deposit;
    2. Capital Projects Expenditure Ordinance No. 10D - Outlining the expenditures from the Capital Projects Funds for October 17 through October 23, 2002; Capital Projects Expenditure Ordinance No. 10E - Outlining the expenditures from the Capital Projects Funds for October 24 through October 30, 2002;
    3. Application for Christmas Tree Permit – Knox United Presbyterian Church, 9595 W. 95th Street, (application for sales at locations zoned other than allowed per OPMC 5.16 may be granted by the Governing Body);
    4. Applications for New Drinking Establishment and Caterers Licenses, and Renewal of Drinking Establishment License, as listed on the agenda;
    5. Approved 30 applications for Renewal of Cereal Malt Beverage Licenses, as listed on the agenda.

    COMMUNITY DEVELOPMENT: STAFF ITEMS:

    1. Resolution No. 3300 – Declaring the eligibility of the City to submit an application to the Kansas Department of Transportation for use of transportation enhancement funds for the Tomahawk Creek Bike/Hike Trail Project.

    PUBLIC SAFETY: STAFF ITEMS:

    1. Application for New Massage Therapy Business License and Renewal of Massage Therapy Licenses, as listed on the agenda.

  6. Approved the rescission of the award of used trucks to Jansen Motors for the purchase of two retired 1991 crew cabs at $2,950 each for a total bid amount of $5,900, due to lack of response from the bidder.

  7. Approved applications for New Drinking Establishment Licenses, Renewal of Caterers License, and Renewal of Drinking Establishment Licenses, contingent on receiving state licenses, as listed on the agenda.

  8. Approved the acceptance of the quit claim deed and the termination of the interlocal agreement between the City of Overland Park and the Blue Valley School District for the lease of the Tomahawk Ridge Elementary School, contingent upon the satisfactory repair of problems identified by the physical and mechanical inspections; and approved the City’s intent to pay the final bond payment in 2004, in the amount of $50,000, contingent upon future budgetary authority.

  9. Approved amendment to the agreement with the Village Presbyterian Church, extending the term of the land lease agreement through December 31, 2012, for parkland in the vicinity of 99th Street and Mission Road.

  10. Approved Resolution No. 3298, declaring the intent of the Governing Body to purchase land for the future construction of a community center and to issue general obligation bonds.

  11. Approved the following Planning Commission Consent Agenda items, as stipulated:
    1. Acceptance of Right-of-Way – Final Plat No. 2002-76, Forest Glen, 7th Plat, vicinity of the northwest corner of 138th Terrace and Rosehill Road;
    2. Revised Preliminary Plan Approval - The Fountains, 6321 W. 119th Street;
    3. Revised Preliminary Plan Approval – Stonepost Apartments, vicinity of the southwest corner of 135th Street and Rosehill Road;
    4. Ordinance No. Z-2952 (Special Use Permit No. 2002-24), 9188 W. 135th Street, for a two-year period of time, to allow an animal kennel, with stipulations a and b.

  12. Approved the sign deviation for the First Bank of Medicine Lodge, 7401 W. 135th Street, with stipulations a, b, and with added stipulation c to indicate that no direct lighting shall be permitted on the sign.
