OP City Council Action Summary - Mar. 4, 2002

  1. Heard report from the Committee-of-the-Whole meeting of March 4, 2002, and adopted the 2002 National Legislative Program that outlines the City’s legislative priority initiatives and standing policy positions, as recommended by staff, with the exception that the Regulatory Proposals Regarding Telecommunications item is to be moved from a standing policy position to a priority initiative.

  2. Approved the following Consent Agenda items, with the exception of the Agreement with CLASP item under Community Development, which was removed from the agenda:

    PUBLIC WORKS: COMMITTEE CONSENT ITEMS:

    1. Storm Drainage Variance – Stonebridge Court, southwest corner of 159th Street and Antioch;
    2. Resolution No. 3265 – New sidewalk construction in established neighborhoods;
    3. Addition to 2001 Residential Streetlight Project – 92-9300 blocks of 100th Street.

    STAFF CONSENT ITEMS:

    1. Resolution No. 3259 – A resolution setting forth findings and determinations of the Governing Body on the advisability of the creation of Improvement District No. 02-186 for the installation of retaining walls and incidental grading, excavation, and construction to help stabilize existing bank slope and minimize future bank erosion in order to help protect four properties located along the east bank of a tributary to Tomahawk Creek;
    2. Resolution No. 3260 – A resolution authorizing and providing for the creation of Improvement District No. 02-186 for the installation of retaining walls and incidental grading, excavation, and construction to help stabilize existing bank slope and minimize future bank erosion in order to help protect four properties located along the east bank of a tributary to Tomahawk Creek;
    3. Resolution No. 3261 – A resolution setting forth findings and determinations of the Governing Body on the advisability of the creation of Improvement District No. 02-187 for the installation of approximately 70 lineal feet of rock shear key as well as incidental grading, construction and restoration to improve bank stability and help protect a property located along the east bank of a tributary of Tomahawk Creek;
    4.     FINANCE, ADMINISTRATION AND ECONOMIC DEVELOPMENT: COMMITTEE CONSENT ITEM:

    1. Ordinance No. CF-2346 – Increasing the Change Fund for the Department of Planning and Development Services in the amount of $150.

    STAFF CONSENT ITEMS:

    1. Expenditure Ordinance No. 2A – Outlining the expenditures from the General Operating Fund for January 31 through February 13, 2002;
    2. Capital Projects Expenditure Ordinance No. 2C – Outlining the expenditures from the Capital Projects Funds for February 14 through February 20, 2002;
    3. Capital Projects Expenditure Ordinance No. 2D – Outlining the expenditures from the Capital Projects Funds for February 21 through February 27, 2002;
    4. Application for New Drinking Establishment License – Woodson Restaurant Company, d/b/a Hilton Garden Inn, 5800 College Boulevard;

    COMMUNITY DEVELOPMENT: STAFF CONSENT ITEMS:

    1. Withdrew from the agenda the Agreement with Child Care for Low Income Advocacy and Support Program (CLASP) until further information is obtained;
    2. Agreement – Head Start of Shawnee Mission, Inc., to provide a Community Development Block Grant (CDBG) of $30,470 to provide scholarship assistance for the Early Head Start Program for income-eligible Overland Park families;
    3. Interlocal Service Agreement – Johnson County Board of County Commissioners, to provide a Community Development Block Grant (CDBG) of $48,000 for the Home Repair Program to provide home repair service for income-eligible Overland Park home owners;
    4. Agreement - Johnson County Board of County Commissioners, to provide a Community Development Bock Grant (CDBG) of $28,000 to the Home Revitalization Program to provide home revitalization services for income-eligible Overland Park home owners;
    5. Agreement – Johnson County Park and Recreation District, to provide a Community Development Block Grant (CDBG) of $25,200 to provide scholarship assistance for income-eligible Overland Park families to participate in the District’s summer day camp program;
    6. Agreement – YMCA of Greater Kansas City, to provide a Community Development Block Grant (CDBG) of $22,853 to provide scholarship assistance for income-eligible Overland Park families to participate in the YMCA summer day-care, pre-school, and before and after school scholarship programs.

    PUBLIC SAFETY: STAFF CONSENT ITEMS:

    1. Application for New Massage Therapy and In-Office Massage Therapy Business License – Kara Manis LMT-Therapeutic Massage, 10999 Metcalf;
    2. Application for Renewal of Massage Therapy Business License – Nancy Silverforb, Massage Therapist, 8101 Overland Park Drive.

  3. Accepted low bid from Pyramid Contractors, Inc., for Bid Alternate No. 1, in the amount of $1,440,721.10, for the 110th Street & Lamar roundabout.

  4. Accepted low bid from O’Donnell and Sons Construction Company, Inc., in the amount of $8,208,505.37, for Metcalf, 135th Street to 151st Street.

  5. Accepted low bid from Miles Excavating, in the amount of $1,636,970.70, for the Indian Creek Parkway Rehabilitation, College Boulevard to Antioch.

  6. Accepted low bid from Harworth Construction for the 2002 Storm Sewer Maintenance contract, for a subtotal amount of $30,515 for the initial delivery order, a subtotal amount of $434,015 for subsequent delivery orders, and a grand total of $464,530, with a guaranteed minimum amount of $90,000.

  7. Accepted low bid from Miller Paving & Construction, Inc., for the 2002 Sidewalk/Curb Repair Program – Indefinite Delivery, for a subtotal of $56,198 for the initial delivery order, a subtotal of $42,900 for the subsequent delivery orders, and a grand total of $99,098.

  8. Accepted low bid from Wiedenmann & Godfrey Construction, Inc., in the amount of $347,747, for the 2002 Major Storm Sewer Repair, Metcalf Ditchliners.

  15. Approved Resolution No. 3264, regarding a five-year City/County Street Improvement Program (2003 – 2007 CARS Program).

  16. Approved application for Renewal of Drinking Establishment License, contingent on receiving State License – Jalapenos of Kansas, Inc., d/b/a Jalapenos Mexican Restaurant, 7729 W. 151st Street.

  17. Approved Contract with Soft Link, Inc., for PeopleSoft Version 8 Upgrade Assistance, in an amount not to exceed $55,000.

  18. Cancelled the Community Development Committee meeting scheduled for Wednesday, March 6, 2002.

  19. Rejected bid for St. Andrews Clubhouse carpeting, and will rebid project.

  20. Approved request to extend premises to sell alcoholic liquor – W.J. McBride’s Irish Pub, d/b/a W.J. McBride’s Irish Pub, 12030 Blue Valley Parkway, for a one day event, March 17, 2002.

  21. Approved the following Planning Commission Consent Agenda items, as stipulated:
    1. Revised Preliminary Plan – Santa Fe Towers, 8101 Santa Fe Drive;
    2. Final Plat No. 2002-3 – Overland Trail Office Park, vicinity of the northeast corner of 135th Street and Lamar;
    3. Ordinance No. Z-2920 (Special Use Permit No. 2001-53), 9617 West 87th Street, for a five-year period of time to allow an arcade;
    4. Ordinance No. ZRR-2345, (Zoning Text Amendment No. ZRR-2345) – Amending Unified Development Ordinance Sections 18.110.460, 18.140.190, 18.140.200, 18.150.010, 18.174, and 18.176 to create two new residential open space zoning districts.
